The provisions of this deed will not extend to Confidential Information that was:
(a)in, or acquired from, the public domain or, without fault on the part of the Recipient or its Related Entities or Personnel becomes within the public domain;
(b)known to the Recipient prior to the commencement of this deed; or
(c)acquired by the Recipient from a person whom the Recipient reasonably believed was under no obligation of confidentiality relating to such information.
