the total liability of UH to the Client arising under or in connection with this Agreement, whether in contract, tort (including negligence), breach of statutory duty or otherwise shall in no circumstances exceed the total Fees payable to UH (or payable up to the date of the claim if the Fees are not payable on a fixed price basis).
