11.2.1 Has failed to commence the Works promptly or except as approved by the Client, has been behind the Schedule for more than 10 days; or
11.2.2 refuses or is unable to provide sufficient materials, services or labor to perform and complete the Works is the manner specified in the Contract at rates of progress that give reasonable assurance to the Client that the Consultant can achieve completion of the Works as set forth in the Schedule; or
11.2.3 defaults in the performance of any provisions of the Contract, Then the Client may, without prejudice to any other rights it may have under this Contract, give a notice to the Consultant stating the nature of the default, and requiring the Consultant to remedy the default, If the Consultant fails to remedy or to take adequate steps to remedy the default within 15 days of its receipt of that notice (or within any other time as the Parties may agree), then the Client may immediately terminate this Contract by giving a notice of termination to the Consultant.
