Discussion: Has anyone here gone from a PhD to patent law?
I am a Ph.D. with 10+ years working in life sciences research who migrated from the bench to law school and specifically, patent law. My advice to you, Paul, is that you take the Patent Bar and work as a patent agent before you even think of going to law school and making that kind of financial expenditure. Working as a Patent Agent will allow you to test the patent law waters before making a full commitment to becoming a patent attorney. You may find that you are completely satisfied with being a Patent Agent. This means that you will be able to prosecute patent applications before the USPTO, but without a JD and state bar admission, you will not be able to litigate patents. You should be detail-oriented and enjoy writing. If you are really fortunate, you may work for a law firm or company that is willing to pay for you to attend law school.
