8. REJECTION/ACCEPTANCE OF GOODS OR SERVICES.(a) Rejection Period. Buyer shall have the period specified in the Supply Agreement (if any), the Purchase Orderor any Special Terms and Conditions or, if no period for rejection is specified for all or a part of the Goods orServices, a period of thirty (30) days) after delivery and receipt of a Good at the Destination or completion of aService, as the case may be (“Rejection Period”), to reject such Good or Service as not meeting therequirements of the Purchase Agreement; provided, however, if a Good is equipment intended to be installed andused at a facility owned, leased or operated by Buyer or one of its Affiliates and the Purchase Agreementspecifies one or more performance requirements that such equipment is to satisfy, unless a different period isspecified for such Good in the Supply Agreement (if any), the Purchase Order or any Special Terms andConditions, the Rejection Period shall be shall be six (6) months after delivery and receipt of such Good at theDestination or, if Supplier is to install such Good, the Rejection Period shall be shall be six (6) months afterinstallation of such Good at the Destination. If Buyer does not issue a notice of rejection with respect to a Goodor Service within the Rejection Period, such Good or Service will be deemed accepted upon the expiration of theRejection Period; provided, however, if Buyer issues a notice of acceptance with respect to a Good or Serviceprior to the expiration of the Rejection Period, such Good or Service will be deemed accepted upon the issuanceof such notice of acceptance.
