The employer is the custodian of the contract document, which must be available for inspection by the contractor at all reasonable times (clause 2.8.1). Employer has the power to defer the giving of possession of the site or part, for the period not exceeding 6 weeks or the period in the contract particulars (clause 2.5). Under the clause 2.7, if the contract documents provide necessary information and the contractor permits it, the employer has the power to carry out the work not forming part of the contract by the employer or employer’s person. If the contract documents don’t provide information, contractor’s consent is required, which cannot be unreasonably delayed or withheld. Employer has the power to take possession of part of the works, if the employer so wishes and the contractor has given his consent (clause 2.25).
